1. GENERAL TERMS AND CONDITIONS OF BUSINESS

These general terms of business define the conditions for using the services of Nikola Božić, owner of NIZ service business (hereinafter: NIZ service business), all in accordance with the previously concluded Contract.

 

By signing the contract, the contracting parties accept the general business conditions.

 

The conclusion of the contract will always be preceded by negotiation between the parties on the essential components of the contract.


The contract is concluded when the contracting parties agree on the essential components of the contract, after which the contract is signed.

The contract must be signed by the contracting parties before the start of service provision.

 

The Contract shall clearly state the rights and obligations of each contracting party, which the contracting parties have previously negotiated.

2. WORK CONDITIONS

The customer of the service/principal undertakes to provide the service provider/consignee with all the information he needs and is necessary for the fulfillment of his obligations under the contract, i.e. for the orderly performance of the work.

 

The customer of the service/ principal is obliged to allow the service provider/consignee to enter the property that is the subject of the contract, and access all parts where work needs to be done, all in accordance with the contract.

 

If the customer of the service/principal does not do so, the service provider/consignee has the right to charge a fee, that is, it will be considered that the service provider/consignee has properly completed the work on that day.

 

The customer of the service/principal and service provider/consignee agree that mutual rights and obligations will be regulated by a contract that they are obliged to enter into before starting work.

3. CONCLUSION OF THE CONTRACT

The conclusion of the contract is preceded by negotiation between the parties on the essential components of the contract. After the verbal agreement of the parties, the service provider/consignee sends the customer/principal a payment offer and a contract. Upon receiving the offer for payment and signature of the contract, it is considered that the contract has been concluded, as well as that the service customer/principal has accepted the general terms and conditions of the service provider/consignee.

 

The rights and obligations of each contracting party are defined by the contract.

4. EQUIPMENT AND CLEANING AGENTS

The service provider uses its cleaning equipment and cleaning agents that are environmentally friendly and not harmful to human health. It is also possible to use cleaning agents provided by the service customer, if so determined during the agreement regarding the process of the cleaning service. 

5. TERMINATION OF THE AGREEMENT

If the service customer/principal cancels the contract before the expiration of the term for which the contract was agreed on, he is obliged to pay the service provider/consignee the entire contracted amount, as if the contract had been executed in full. 

6. RIGHT OF COMPLAINT OF THE SERVICE CUSTOMER/PRINCIPAL

After the service provider/consignee fulfills his obligations from the contract, i.e. after the service has been provided, the service customer/principal is obliged to check the quality of the work performed and in case of dissatisfaction or irregularities in said work, is obliged to inform the service provider/consignee about this within 24 hours. 

7. PRICES

All prices published on the NIZ service business website are in kuna.

 

All prices are tentative and subject to change if the service provider/consignee finds a situation different from the one presented in the field, and they certainly depend on the agreed service package. 

8. PROVISION OF SERVICES

We receive inquiries for our services via e-mail, telephone, a.k.a. written or verbal. Each inquiry must include the time, place and description of the work to be done.

 

After the inquiry, the service provider/consignee confirms to the service customer/principal that the inquiry has been received, and informs them of the time and place of performance of the service, as well as the price. The customer of the service/principal will receive the invoice in written
or electronic form no later than 48 hours after the service/work has been performed.

9. PRIVACY STATEMENT

When paying for the service, the service customer/principal gives express consent to NIZ service business, as the administrator of the personal data database, to collect and process personal data resulting from the contractual relationship with the service customer/principal in the following categories of personal data:

  • name and surname
  • OIB
  • primary address
  • e-mail
  • phone number
  • archive of any additional communications
  • data on ordered services

 

When ordering services, the service customer/principal gives his consent that his personal data may be used for the following purposes:

  • service performance
  • advertising
  • statistical analyses
  • implementation of market research
  • sending advertising materials
  • notifications about news in the offer and business

 

Photographs of the work done for the client’s property can be used for all above stated purposes. 

10. SUBJECT OF SERVICE/ORDER

The description of the service/job, or the order that the service provider/consignee must perform, will be defined in detail in the contract that the contracting parties will sign before the start of the work, so that there are no subsequent misunderstandings in the field during the work. 

11. METHOD OF PERFORMING THE SERVICE

The NIZ service business personally performs the work undertaken, but it is also possible to hire additional workforce, and to entrust the work performed to other persons, who are in a business relationship with the service provider/customer. 

12. RESPONSIBILITY OF THE SERVICE CUSTOMER/PRINCIPAL

The customer of the service/principal is responsible for providing wrong, false, or incomplete information when ordering the service in one of the above ways.

 

The customer of the service/principal is responsible for incorrect or untimely objections or appeals to the issued invoice for the performance of the service.

 

The customer of the service/principal is obliged to inform the service provider/consignee of deficiencies and irregularities immediately or within 24 hours at the latest after the work has been performed/service provided. 

13. RESPONSIBILITY OF THE SERVICE PROVIDER/CONSIGNEE

The service provider/consignee is responsible in providing the service customer/principal the professional, high-quality and timely execution of the service in accordance with their order.

 

The service provider/consignee undertakes to comply with the house rules of each facility, instructions for fire protection in the facility, and instructions for their own safety in the facility where the service is provided.

14. GOVERNING LAW AND DISPUTE RESOLUTION METHODS

In the event of a dispute between the aforementioned parties, they will try to resolve it amicably, and if this is not possible, they agree to the jurisdiction of the Municipal Court in Rijeka. 

15. CANCELLATION AND POSTPONEMENT OF SERVICE IN CASE OF EMERGENCY CIRCUMSTANCES

In case of unexpected breakdowns, illness or death of employees, weather problems and other force majeure, the service provider/consignee reserves the right to cancel or postpone the service. 

16. PAYMENT TERMS

NIZ service business is not in the VAT system, and invoices are issued after the service has been rendered, unless otherwise stated in the offer or contract. The method of payment is to the transaction account of the service provider/consignee.
